In a disturbing audio clip, Ed Brown speaks for the first time since his arrest and relates how he was gassed by noxious fumes for three days in a detention center as well as being put in a deprivation tank for 15 hours.

Shaun of MaketheStand.com was able to call the Ohio prison that Brown has been incarcerated in and talk with him on the phone for 10 minutes.

Sensory deprivation is a form of torture and extended deprivation can result in extreme anxiety, hallucinations, bizarre thoughts, depression, and antisocial behavior.

Brown also said he had been prevented from making any phone calls or receiving mail.

For the first time, Brown reveals what happened when he was tricked and arrested by U.S. Marshals, including how he was tasered multiple times.

Brown said that he had a chance to fight back during the arrest but that he did not want to hurt anyone.

Brown said his captors were treating him with "professional cruelty" and mentioned that they had also done harrowing things to his wife following her arrest, but refused to go into detail.

"I guess Ed and Elaine Brown, the elderly couple, really rattled their cages, we must be a real terror to the federal government, the corporate structure," said Brown.

Following our article about Ed Brown supporters fearing Brown was being mistreated or tortured, U.S. Marshal Stephen Monier dismissed it, saying, "That's absolutely ludicrous."

From what Ed Brown relates in the audio clip, it's abundantly clear that he is being cruelly mistreated.

There is hereby imposed on all distilled spirits produced in or imported into the United States a tax at the rate of $13.50 on each proof gallon and a proportionate tax at the like rate on all fractional parts of a proof gallon.

Rate of tax -
(a) Cigars - On cigars, manufactured in or imported into the United States, there shall be imposed the following taxes:

(1) Small cigars
On cigars, weighing not more than 3 pounds per thousand, $1.828 cents per thousand ($1.594 cents per thousand on cigars removed during 2000 or 2001);

What's so hard about that. They didn't need to cut down a forest to print up that explanation, fairly simple and understandable isn't it? Don't even need a lawyer or accountant for that, do you?! Tax protesters Ed and Elaine Brown were tricked by US Marshals who entered their home yesterday afternoon posing as supporters. The Marshals entered the house at a time when there were no other supporters present and catching the Browns off guard were able to arrest them and remove them from the property.

According to the mainstream media Ed and Elaine Have Been "arrested" without incident.

The Union Leader however reports that: U.S. Marshal Stephen Monier said that the two did not surrender. At this point and time the Feds are not releasing any details on the reported "arrests".

According to Fox News: Details on the reported "arrest" will be provided in a news conference at the federal courthouse in Concord NH on October 10th 2007.

It is currently not clear how the couple who did not surrender were kidnapped without incident.

The Internal Revenue Service has lost a lawyer's challenge in front of a jury to prove a constitutional foundation for the nation's income tax, and the victorious attorney now is setting his sights higher.

"I think now people are beginning to realize that this has got to be the largest fraud, backed up by intimidation and extortion and by the sheer force of taking peoples property and hard-earned money without any lawful authorization whatsoever," lawyer Tom Cryer told WND just days after a jury in Louisiana acquitted him of two criminal tax counts.

And before you consign him to the legions of "tin foil hat brigades" who argue against paying taxes, and then want payment to explain how to do that, he addresses the issue up front.

The local newspaper headlines rang with dire warnings for all who would attend the Live Free or Die jamboree held on Ed and Elaine Brown's front yard July 14th.

"That's an illegal gathering, and it's not a safe situation for anybody to really go to, and the people who go there have to realize that. . . . We can't say it's safe for anybody to go there. We will not send emergency vehicles into this area, no matter what." said Plainfield Police Chief Gordon Gillens.

Gillens also warned people in advance that no emergency services would be provided for concert goers as it was too dangerous to send them in to the area. Attendees were also warned that many would be armed and again were on there own if anything should turn ugly.

(The so called police presence was thin with only Chief Gillens, and officer O Sullivan at the bottom of the road, though reports of Federal officers coming and going were constant. The Brown's were kind enough to send the boys some hamburgers which they appreciated and consumed.)

Ed Brown responded by assuring the police that he didn't need any assistance by the city or state, and that we were perfectly capable of handling whatever might happen.

But assistance he received as airspace was closed over Plainfield through Boston and surrounding airports while a mysterious white helicopter circled the crowd of 200 for about 6 hours, flying so low at times it appeared to be coming in for a landing. At one point, after apparently refueling… The chopper returned appearing about 100 feet out of the trees. It must have been lying low in silent mode before it jumped out and buzzed the crowd. It felt like apocalypse now, Vietnam or Iraq.

The chopper was traced by its ubiquitous ID numbers N187AE as solo artist Dave Cahill was tearing through a blistering set on stage. With the help of GCN radio host Mike Rivero of www.whatreallyhappened.com we were able to determine that the helicopter was created exclusively for the US Government, and was registered to Homeland Security, and this was announced to the live audience and live web viewers.

Ed Brown at one point called the FAA to warn them that the chopper was too low, and could be in harm's way as a commercial fireworks show was planned for later that evening. It seems to be debatable at this time whose airspace DHS was operating in, state or federal. It would seem that DHS can and will do what they want just the same.

I had the opportunity to interview Chief Gillens about this and in fact it was news to him. Ironically, he wasn't in the loop until we alerted him to the situation regarding DHS. He had been superseded by the Feds repeatedly that day, and Gillens like the rest of us was at their mercy.

Maybe this was the culmination of Michael (the Devil) Chertoff's "gut Feeling" and concert goers were all relieved that any attempt by Al Qaeda to attack the Brown home would be thwarted by the DHS Chopper.

In my opinion it was incredibly clumsy to have sent this chopper to harass the Browns, and their guests as I was grateful for the expensive show of force on peace loving constitutionalists. If I could have I would have paid them to do it… It looked great for the many cameras ..ing the event, and must have been thrilling for those watching on the myriad of live web casts. A perfect example of what we are talking about, and succinct imagery to go with the anti police state music and message echoing throughout day. You really couldn't have planned it better I thought, and DHS played right into our hands.

At one point, as darkness closed in, and after hours of constant buzzing and low level hovering (no doubt recording every move we made for future reference) the crowd became bolder. Ed had gone down into a pasture for reconnaissance which was certainly concerning as the chopper with a sniper could have easily taken him out. Flanked by videographer Terry Melton, and backed up by myself and others proudly defying the DHS Chopper while holding banners for "From Freedom to Fascism" and making "certain" hand gestures…. The laugh was on them.

A spotlight war began as one Brown supporter hit the chopper with a high powered light beam while the white helicopter answered back with a flood of light of their own.

As for the event itself? It was an overwhelming success!

The music was excellent and perfectly placed. Opening the show was a message by Ed and Elaine who seemed overjoyed by the attention, and support. Dave Von Kliest of the GCN Morning show The Power Hour did a great job opening with his original tune, "Show Me The Law"

(All gave heart felt talks for the roaring crowd) next up was the cool organ driven tunes of Paperback Radio who came in by private bus from NJ and sounded awesome under the 80 degree sun.

The headliner Pokerface blistered the stage for 90 minutes playing many of their hits including "America", "the Watchmen" and and "Prayer For America"<

So the Live Free or Die concert at Ed Brown's house was amazing! I took a bunch of photos... Here is the first of many that I am putting out there. Please forward this to your friends. All Americans should know the Ed and Elaine Brown story. It is monumental! Homeland Security was there all day watching and harassing us and I have pics to prove it! At one point their chopper was so loud and hovering so low that we couldn't even hear the band playing! Regardless of their intimidating tactics, we didn't get scared and some of us even taunted them back!

U.S. marshals in New Hampshire have made plans to arrest convicted tax protesters Ed and Elaine Brown of Plainfield, along with their supporters, according to an anonymous Justice Department source who also threatened this author with jail.

“Anyone who is going to carry out plans killing officers, agents, and government persons after Ed is arrested is in way over their head,” said the message, which was routed through a proxy server in a failed attempt to obscure its source. “If you continue to pursue these threats, you along with several of your fellow Ed supporters are going to jail. Ed is a convicted felon and several more are going to be rounded up in their stupity [sic].”

Ed and Elaine Brown stopped attending their tax evasion trial in January saying they could not receive a fair trial. They were convicted and sentenced in absentia to 63 months in prison each for various charges of tax evasion and money laundering. Since that time, the couple have remained in their home and vowed to resist with deadly force anyone who attempts to seize them and take them to prison.

Two weeks ago, I said here that while I don’t believe that shooting federal agents is the appropriate thing to do at this time, I support those who would challenge the income tax laws as they amount to nothing more than theft and slavery, and can never be legitimate, no matter how many judges agree.

How some desk jockey at the Department of Justice confused this with a threat of violence, I can’t tell.

Anyway, if you are an Ed Brown supporter, put your affairs in order. They’re probably going to try to take you away, too, whether you have made any threats of violence or not.

The most honorable way to revamp the income tax code is to sunset it out of existence and start over with a clean slate

In 1913, Congress and the States created the federal income tax to pay for America’s growing federal government and its new leadership role in the world. We started with a 30-word constitutional amendment (the Sixteenth) and a four-page form for the collection of graduated income taxes. The lawmakers who wrote the initial income tax law had little idea what it would become today.

With a $20,000 exemption, most Americans (98 percent) didn’t have to pay any income tax while the wealthiest paid from one to seven percent in taxes when the new income tax started. By the late 1970s, Americans in the top tax bracket were paying more than 80 percent of their income to Uncle Sam. Today, the highest marginal tax rate is just less than 40 percent; 54 percent of all federal income tax is paid by the top 20 percent of wage earners; the 20 percent who are the lowest wage earners pay six percent. The tax code has become a monster.

Virtually all businesses, large and small, have a tax accountant to safely maneuver around the pitfalls of the IRS code. But the code is so complicated, even the experts fall prey to its tricks and turns. We spend an estimated 5.4 billion hours a year and $200 billion trying to comply with a code that is incomprehensible. That is more than it takes to produce every car, truck and van in the United States.

The Internal Revenue Service, which was created in 1913, is now the largest single agency of the federal government with more than 135,000 employees which nearly equals the entire population of Springfield, MO, the Congressional district that I represent in Congress.

The American income tax code is perhaps the world’s most revised, lobbied and despised document_ Every year, it seems, it is rewritten. In 1997, more than 200 changes were added. Most professions, industries, income groups, crafts and special interest groups have their own tax niche in the code. It is no wonder that lobbyists watch every change in the tax code microscopically to determine its impact on their turf.

Nothing would eliminate special interest lobbying more quickly than eliminating the current tax code.

If the tax code were based on simple principles rather than intentionally complex legalese, those companies, professions and interest groups would lose their special tax treatment, and therefore, be subject to paying their fair share of the tax burden. A tax code that rewards savings, taxes everyone fairly, is simple and understandable, but does not raise more taxes than the federal government gets now – should be our goal. We can only achieve that by eliminating our current tax code.

The only way to end the IRS as we know it is to eliminate the existing tax code. The current tax code is the evolutionary work of Congress. It’s the job of Congress to fix it. The fairest, most honorable way to revamp the income tax code is to sunset it out of existence and start over with a clean slate. We can then set to work on designing a tax code based on simple principles that every American can understand.

That is impossible today. The tax code is 5.8 million words long, covering 7,000 pages of tax law and 5,000 more pages of interpretations of the first 7,000 pages. The IRS prints 480 different tax forms and more than 280 brochures on how to fill out the forms. The 1040EZ tax form, the least complicated personal income tax form, requires 33 pages of instructions. NO one understands – not even the employees at the IRS who are supposed to enforce it – all the aspects of the American income tax system. It is so cumbersome, dense and complex that it is beyond comprehension. A new $4 billion IRS computer system was declared a "failure" because it could not decipher the tax code.

The IRS has built its reputation of fear and intimidation on the ever-changing tax code. The tax code is like quicksand. You are on solid ground one day and sinking the next. Case after case has been documented to show that IRS tax interpretations are ever-changing and often inconsistent. What is legal one year may be declared illegal the next year, and made retroactive creating years of back tax liability!

Senate hearings in 1997 showed the IRS targeting those least able to defend themselves against egregious fines and improper conduct by the IRS. In fact, the IRS gave bonuses to agents who did the best job of collections, without regard of their tactics or principles.

Tax court is the only civil court where a person is guilty until he can prove he does not owe the taxes the IRS claims.

Reforming the way the IRS collects taxes is coming from both inside the IRS and the Congress. Twenty-eight new "taxpayer rights" have been approved by the House. Most notable are new safeguards that shift the burden of proof from the taxpayers to the IRS about taxes owed. Another provision allows the taxpayer to recover legal fees in fighting frivolous IRS claims. Reforming the IRS may solve some problems, but until the code is replaced with a simple, fair alternative there is little hope of getting the "little guy" out from under the IRS’s guns.

More than 40 percent of the $13 billion in proposed tax fines were dropped in 1996 when challenged as excessive. It is normally the wealthy who have the resources to challenge the taxman. So, middle Americans are being targeted to pay. Is it any wonder that most people would rather pay than fight the IRS? We can never cure these kinds of abuses as long as we have the current tax code. Despite Congressional efforts to make the IRS more professional and user-friendly, it is more likely the agency will stay entrenched and hide behind a tax code that is neither fair nor understandable.

I’m co-sponsoring the Tax Code Termination Act (HR 3097) which sunsets the federal tax code as of Dec. 31, 2001. We need to debate real tax reform, not just patches to the existing system. The tax code is hopelessly broken and abolishing it is the necessary first step to debating, designing and adopting a simple and fair replacement tax system. Under the Tax Code Termination Act, today’s oppressive tax code would survive for only four more years, at which time it would expire and be replaced on Jan. 1, 2002, with a new tax code that will be determined by Congress, the president and the American people.

Admittedly, scrapping the existing tax code and replacing it with a better system is not a simple task. However, four years is plenty of time for the nation to collectively decide on a new tax system. Having a date certain to end the current tax code will force the issue to the top of the national agenda, where it will remain until Congress and the president finish writing the new tax law.

Between now and 2002, we need to continue eliminating unfair parts of the current tax code. The "marriage penalty," death taxes and taxes on sales of property and stocks not indexed to inflation are wrong. We should knock a few of them off while we debate the kind of fairer, simpler tax structure that we want to take into the 21st century.

If Americans truly want tax reform, it must begin with the creation of a new tax system based on principles, not the ability of lobbyists with armloads of campaign contributions to sway congressional opinion. LL

Considering what the government is doing to “tax protester” Irwin Schiff, it makes sense the “tax protesters” Ed and Elaine Brown have vowed to die before allowing hired guns working in the service of the psychopathocracy to take them in.

According to a post on the Rumor Mill News website, political prisoner Schiff was “was given the diesel treatment,” that is to say his sadistic wards put him on a bus, trussed in shackles, and drove him around for twelve or more hours. “The blood pools in your legs… the shackles cut in to your skin. You are NOT allowed to go to the bathroom, so people urinate in their clothes,” the post explains. “Prisoners are routinely given shoes that are too small… toe nails become ingrown to the point that prisoners have to pull them out with pliers to ease the pain… This is what happened to Irwin… they gave him boots that were too small. His foot became infected, he developed gangrene and they had to amputate his toe.”

For those unfamiliar with Schiff, he is 78 years old and serving 151 months in prison and was ordered to pay over $4.2 million in restitution to the Internal Revenue Service for the crime of not paying “income taxes,” otherwise known as slave ransom, or that’s what your humble blogger calls it, anyway. He currently languishes, apparently minus a toe, as Inmate #08537-014 at the Federal Correction Institution at Fort Dix, New Jersey, located on the Fort Dix/McGuire Air Force Base military installation. Fort Dix was in the news recently when a pizza delivery guy threatened to attack the base and kill as many soldiers as possible.

IRS Generalfeldmarschall Mark Everson told the media upon Schiff’s conviction in 2005, “Paying taxes is the price of citizenship. After three strikes, I would hope that even Schiff realizes that he has struck out.” Indeed, Schiff not only “struck out,” but apparently is in the process of losing body parts due to the Abu Ghraib-like conditions at Fort Dix.

Of course, it was our psychopathic rulers who long ago decided paying ransom, er income taxes, is “the price of citizenship,” as this was considered a reprehensible concept until the 16th Amendment was “ratified” in 1913. No doubt Mr. Everson missed history class on the day the teacher told the story about Thomas Jefferson, who managed to repeal all direct federal taxes—call it ransom, excuse me, income taxes—passed by the Federalists and boasted that ordinary Americans would never see a federal tax collector in their whole lives. Back in the day, the Republicans fought not only against direct taxes, but the authoritarian Alien and Sedition Acts foisted on the country by the Federalists. Nowadays, Republicans make the Federalists of yore look like pikers.

Again, considering the “diesel treatment” meted out to Schiff, the determination of Ed and Elaine Brown not to be taken alive makes perfect sense, as only a masochist would allow himself to be subjected to such brutal abuse, purposely inflicted by minions in the service of our rulers, who are criminal psychopaths.

Naturally, the taxes we are now paying will pale in comparison to what is coming, beginning with the so-called “carbon tax,” that is to say a fleecing scheme predicated on a ruse or at best an unsubstantiated theory based on junk science. Other taxes will of course follow, as our rulers have a mighty thirst for thievery and, unfortunately, far too many Americans are easily distracted and bamboozled when the government snake oil wagon trundles down Main Street promising miracle cures against the ills that plague us. Osama bin Laden, the CIA operative, is one such ill, and yet another is “climate change.”

But we are ripe for the picking. And the question is: How many of us will end up no better off, possibly worse, than the average Chinese zek, and how many of us will end up sharing Irwin Schiff’s fate?

No doubt plenty to the former and precious few to the latter.

Greetings Mr. Monier:



This is to inform you formally and officially that my office legally represents the United States ex rel. in Tenth Circuit appeal #07-2017.



In that case, extensive verified evidence has already been admitted into that Court’s record, proving conclusively that there is no Statute at Large creating a specific liability for income taxes imposed by subtitle A of the Internal Revenue Code (“IRC”).



The alleged “liability” was fabricated by the Internal Revenue Service, but there is no corresponding Act of Congress creating that specific liability for any income taxes imposed by IRC subtitle A.



Accordingly, even if the IRS were a de jure service, bureau, office or other subdivision of the U.S. Department of the Treasury (which they are NOT), they would still not have any authority to create a tax liability by means of regulations published in the Federal Register. See 31 U.S.C. 333; Commissioner v. Acker, 361 U.S. 87 (1959).



Moreover, you are hereby served with formal NOTICE that the constitutionality of IRC subtitle A, the federal Jury Selection and Service Act and the Act of June 25, 1948, has now been properly and formally challenged in that Tenth Circuit Appeal.



In the first instance, it is now the position of the United States ex rel. that the Jury Selection and Service Act is unconstitutional because it expressly discriminates against State Citizens by requiring that all jury candidates be federal citizens. The U.S. Supreme Court has already held that such “class discrimination” in jury selection is unconstitutional. There are two (2) classes of citizens in America.



Therefore, the Browns were never “indicted” by a lawfully convened federal grand jury, and they were never “convicted” by a lawfully convened federal trail jury. Both panels of federal citizens were not lawfully convened federal juries, in the first instance.



My office has not yet had an opportunity to review any of the court pleadings filed in the Browns’ case. Nevertheless, our 17 years of experience in State and federal litigation inform us that the U.S. Department of Justice routinely institutes criminal proceedings on behalf of the UNITED STATES OF AMERICA. However, the latter entity incorporated twice in Delaware, and both of those foreign corporations have now been revoked by the Delaware Secretary of State.



To make matters much worse, the long-standing rule in all federal litigation is that statutes conferring original jurisdiction on Federal District Courts must be strictly construed. The Article IV United States District Court has no criminal jurisdiction whatsoever. The general grant of criminal jurisdiction at 18 U.S.C. 3231 confers original jurisdiction upon the Article III District Courts of the United States, not on the Article IV United States District Courts.

Infowars reporters Luke Rudkowski and Matt Lepacek have bravely entered the property of income tax protesters Ed and Elaine Brown in Plainfield New Hampshire as it continues to be surveilled by armed and camouflaged US marshals operating in the area with APC's to shoot video and document the scene in the wake of a typically cowardly mainstream media blackout.

Rudkowski briefly joined Alex Jones on air today along with the Browns themselves and expert correspondent Jack McLamb to recount the dramatic events of yesterday.

Officers have told the AP that the show of force was just a precaution, despite the fact that authorities erected roadblocks a mile around, evacuated neighbors, cut the Brown's phone and power lines and deployed six helicopters along with a SWAT team and six more APC's just to serve warrant.

These are blatant lies and anyone who is capable of holding one thought in their head knows this.

The siege began 3 days ago when the Brown's property was over flown first by two small biplanes and then by a surveillance drone, flying at approximately 5000 feet, shining a bright light down onto the house and the land in the vicinity.

Ed Brown believes that it was a global hawk drone, one of the most sophisticated unmanned aircraft normally used by the US military in war zones such as Iraq and Afghanistan.
That night the power went off in evening and the phone lines were cut. In the morning Brown's friend Danny Riley was walking the dog when he encountered a team of special ops agents hiding out in the trees close to the long driveway at the property.

The Feds can't back off from seizing the Brown's property. It would make them look like whimps, weak. The would never allow that. They will get the property to show their strength. I believe they are in complex planning to try to gain control of their large property with minimal death and injury. I believe that they do not want this confrontation but have to do it to show the strength of the U.S. and that they have control over the people.
